이코노미스트, 국내 어학원 전격 고소

경찰이 영국 경제전문 주간지 이코노미스트의 저작권을 침해한 혐의를 받고 있는 한 국내 어학원에 대한 조사를 진행 중이라고 23일 밝혔다.

이코노미스트의 발행사 이코노미스트그룹은 서울 시내의 한 어학원을 상대로 지적재산권 침해 소송을 제기했다.

이코노미스트그룹 측은 고소장을 통해 이 어학원이 이코노미스트의 저작물을 지난 2009년부터 2011년 사이에 교재 내용으로 사용해 약 1천6백억 원에 달하는 수익을 올렸다고 주장했다.

이에 어학원 측은 해당 잡지의 내용을 사용한 점을 시인하면서도 수익을 도모해 교재를 판매한 것은 아니라고 주장했다.

사건을 담당한 서울 서초구 경찰서의 한 담당자는 “어학원 측이 합의를 원하고 있으며 저작물 사용에 대해 발행사 측과 정식 제안을 하고자 한다”고 밝혔다.

그러나 이코노미스트그룹은 이 제안을 거절한 것으로 알려졌다.

“발행사는 어학원 측이 자사의 저작물을 상업적으로 이용했다는 사실을 부인하고 있어 합의를 거절했다”고 법무법인 대륙아주 소속의 변호인 박종현이 밝혔다. 그는 또한 잡지 표면에 가격이 인쇄되어 있었다는 사실을 지적했다.

어학원 대표는 지난 12일 경찰에 출두해 진술을 했으며 이번 주 내 다시 출두할 예정이다.

박 변호인은, “이와 같은 사건은 외국에서는 찾아보기 힘들다”며 “이코노미스트그룹은 자사의 저작물이 ‘타임즈’와 같은 유명 매체의 저작물과 함께 어학원 교재로 많이 사용되고 있는 것을 알고 있으며 이에 대한 엄격한 조사를 하고 있다. 이 사건은 조만간 검찰로 송치될 것으로 보인다”고 말했다.

The Economist files complaint against language school

Police are investigating an English language institute on charges of breaching a copyright belonging to The Economist, a British weekly magazine, officials said Wednesday.

The publisher Economist Group filed a lawsuit against the English language school in southern Seoul in November for infringing its intellectual property.

The publisher said in the complaint that the language school used its articles and columns in their textbooks from 2009 to 2011, earning up to 160 billion won ($150 million) from the sales.

The language school admitted to using the content of the magazine but insisted they did not sell the study aids with the purpose of making profits.

“The language school wants to settle the case and make a formal contract with the publisher to use their content,” said a police official in charge of the case at Seocho Police Station.

The U.K. publisher, however, rejected the proposal.

“The publisher refused to seek a settlement as the school denied the commercial usage of the content,” said Paik Jong-hyun, the legal representative from the law firm Daeryook and Aju, adding that the price was printed on the textbook.

The president of the language school was questioned at the police station on Jan. 12 and will face another interrogation this week.

“This case is unprecedented in other countries. The publisher recognizes that many language schools utilize English magazines including Time in their textbooks and is taking a close look at the infringement on intellectual property in other schools, too,” said the lawyer.

“The case will be handed to the prosecution soon.”
